St. Charles, Ill. — Fox Valley Magazine reported that there will be no criminal charges filed in the St. Charles accident that killed a five-year-old boy in his own driveway on May 27. Kane County State Attorney Jamie L. Mosser and St. Charles Deputy Police Chief Rich Clark announced the update on June 4.
“This was a heartbreaking and tragic accident that has devastated a family and deeply affected the community,” said State’s Attorney Mosser. In reviewing the facts of the incident, Mosser said no charges would be filed as the tragedy was not the result of negligence, recklessness or criminal conduct.
“It was a moment that no family member of a loved one should ever have to experience. My heart goes out to everyone impacted by this tragedy, especially the family of this young boy.” Mosser then thanked the St. Charles Police Department and Kane County Accident Reconstruction Team for their work on the investigation.
At approximately 5:09 p.m. on Tuesday, May 27, St. Charles Police and Fire Departments reported to the 4000 block of Royal Fox Drive. A five-year-old boy had been struck by a vehicle in his own driveway by an immediate family member. After attempting CPR on the scene, the boy was transported to Northwestern Medicine Delnor Hospital where he was pronounced deceased.
