Bloomingdale, IL – A DuPage County judge has denied a motion to detain Marcus Mizelle, a Bloomingdale man facing charges for allegedly firing a shot at another man during a road rage incident in Roselle. Mizelle, 34, appeared in court charged with aggravated discharge of a firearm and aggravated assault.

According to DuPage County State’s Attorney Robert Berlin and Roselle Police Chief Rob Barreto, Mizelle’s release includes strict conditions. These include surrendering all firearms, ammunition, and his FOID and CCL licenses, as well as maintaining no contact with the alleged victim. Judge Joshua Dieden ruled that while Mizelle’s charges qualify for detention, these conditions reduce the potential danger to the community.

The charges stem from an incident on November 7, when Mizelle allegedly fired at another driver following an altercation on Springfield Drive. The two men reportedly drove to a BP gas station, where Mizelle is accused of aiming a pistol at the other driver and firing before fleeing. Officers identified Mizelle as the suspect and later arrested him at his residence without incident.

Mizelle’s arraignment is scheduled for December 2 in front of Judge Daniel Guerin.
