
Springfield, IL – A proposed Illinois Senate bill aims to eliminate felony murder provisions from the state’s first-degree murder statute, redefining when second-degree murder applies.
According to the Illinois General Assembly, Senate Bill 1788, introduced by Sen. Robert Peters (D-Chicago) and co-sponsored by Sens. Mary Edly-Allen, Mark L. Walker, Laura Fine, and Rachel Ventura, would remove felony murder as a basis for first-degree murder charges. Under the bill, a person committing a forcible felony, excluding first-degree murder, could face second-degree murder charges if their actions or those of an accomplice result in someone’s death.
The bill, filed on Feb. 6, was referred to the Senate Assignments Committee. The Illinois Sheriffs’ Association has voiced opposition to the legislation.
