Lewiston, NY – A Niagara Falls woman was arrested in Lewiston on Saturday night after allegedly driving intoxicated with a child in the vehicle, according to the Niagara County Sheriff’s Office.
Authorities said the arrest took place around 7:30 p.m. on Saunders Settlement Road after deputies received a report of a possibly impaired driver operating a black GMC Yukon with a child in the back seat. Deputy T. Stickney located the vehicle and initiated a traffic stop in front of 2263 Saunders Settlement Road.
According to the sheriff’s office, the driver was identified as 28-year-old Allyson V. Roberts of Niagara Falls. Deputies reported that a young child was observed in a car seat inside the SUV. After field sobriety testing, Roberts was determined to be intoxicated and was taken to the Niagara County Sheriff’s Office for a chemical breath test, which allegedly showed a blood alcohol content of .10%.
Roberts is charged with Aggravated DWI under Leandra’s Law, a felony, as well as misdemeanor counts of Driving While Intoxicated, Operating a Motor Vehicle with .08% or more of alcohol, and Endangering the Welfare of a Child.
Deputies said the 3-year-old child was safely turned over to a family member. Roberts was transported to the Niagara County Jail, where she was held pending centralized arraignment.
Leandra’s Law, passed in New York in 2009, makes it an automatic felony to drive drunk with a child under the age of 16 in the vehicle.
