According to the United States Marshals Service and the Pennsylvania State Police BCI Fugitive Task Force, Akerly is wanted on a federal warrant for unlawful flight to avoid prosecution, along with local charges in Erie County that include rape and aggravated assault.

Investigators said the charges stem from a February 4, 1998, incident in Erie. Authorities allege Akerly encountered a woman at a tavern before convincing her to return with him to a warehouse residence on Plum Street. Police reports state Akerly became violent once inside, repeatedly striking the victim in the head, face, and body.

Court records show Akerly was arrested and charged but failed to appear for trial. His last known address was in Erie, but he is also known to frequent Wattsburg, Erie County; Chautauqua, New York, where officials believe he may be hiding in an Amish community; and parts of North Carolina.
