Livingston County, NY – Man Arrested on Domestic Charges Sunday

Avon, NY – A 23-year-old Avon man was arrested Sunday, September 28, on domestic-related charges following an investigation by the Livingston County Sheriff’s Office.

According to Sheriff Thomas J. Dougherty, deputies responded to a residence in Avon for a reported domestic dispute in progress. Upon arrival, deputies spoke with the victim, who stated the suspect, identified as Joshua James, was allegedly involved in a physical confrontation. During the altercation, James is accused of intentionally damaging the victim’s cell phone while she attempted to call emergency services.

James was taken into custody and charged with felony Criminal Mischief in the Third Degree, misdemeanor Criminal Mischief in the Fourth Degree, misdemeanor Criminal Obstruction of Breathing, and Harassment in the Second Degree.

He was transported to the Livingston County Jail for booking and pre-arraignment detention. James later appeared before a judge at the Livingston County Centralized Arraignment Part (LC-CAP) and was released on his own recognizance, as the charges do not qualify for bail under New York State’s Bail Reform Act.

The Livingston County Public Defender’s Office represented James during his arraignment. The Livingston County District Attorney’s Office was also present. Sheriff’s officials noted that members of the Patrol Division, Forensic Identification Unit, and Criminal Investigations Division assisted with the case.
