Lima, NY – A Lima resident is facing a felony Driving While Intoxicated charge following an early morning traffic investigation that began with reports of downed utility wires in the Town of Lima.
According to the Livingston County Sheriff’s Office, deputies responded at approximately 2:43 a.m. Saturday, December 13, to the area of Dalton Road after receiving reports of wires down across the roadway. Upon arrival, deputies determined the wires had been knocked down during a motor vehicle crash.
Sheriff’s officials say Deputy Hayden Strobel made contact with the vehicle’s operator, who was identified as 36-year-old Mark Snyder of Lima. During the initial encounter, the deputy allegedly observed signs that Snyder may have been under the influence of alcohol.
According to authorities, a Driving While Intoxicated (DWI) investigation was conducted, including standardized field sobriety tests. Snyder was subsequently taken into custody on suspicion of DWI. Deputies reported that Snyder was offered a chemical breath test to determine his blood alcohol content but refused to submit to the test.
A criminal history check later revealed Snyder had a prior DWI conviction from Ontario County in 2016, which elevated the current charge to a felony under New York State law, according to the sheriff’s office.
Snyder was charged with felony Driving While Intoxicated along with additional violations of the New York State Vehicle and Traffic Law. He was transported to the Livingston County Jail for processing and pre-arraignment detention.
Authorities say Snyder was later arraigned in Livingston County Centralized Arraignment Part (LC-CAP) before Leicester Town Justice Durbin. The judge released Snyder on his own recognizance, as the charges do not qualify for bail under the New York State Bail Reform Act.
The Livingston County Public Defender’s Office represented Snyder at arraignment, while the Livingston County District Attorney’s Office appeared on behalf of the prosecution.
