York, NY – A Livingston County man was taken into custody Wednesday evening after deputies allegedly observed erratic driving that led to a felony driving while intoxicated arrest in the Town of York.

According to the Livingston County Sheriffโ€™s Office, the incident happened Wednesday at approximately 6:26 p.m. near Main Street and Genesee Street, where deputies were dispatched for reports of a vehicle allegedly being operated in an erratic manner. Authorities said the vehicle had pulled into a business on Main Street prior to their arrival.

Deputies made contact with the driver, identified as 33-year-old Brandon Becker of Avon, who allegedly showed signs of intoxication during the initial encounter. Investigators with the Sheriffโ€™s Office STOP DWI Unit conducted a DWI investigation, including standardized field sobriety tests, after Becker allegedly exhibited impairment. He was subsequently taken into custody.

Officials said Becker was transported to the Livingston County Sheriffโ€™s Headquarters in Geneseo, where a breathalyzer test allegedly revealed a blood alcohol content of 0.20%, more than twice the legal limit.

A records check reportedly showed Becker allegedly had a prior conviction for driving while ability impaired by drugs in 2018, elevating the current charges to a felony.

Becker was charged with felony DWI, aggravated DWI and additional violations under New York State Vehicle and Traffic Law. Authorities said he was processed at the Livingston County Jail and later arraigned in Livingston County Centralized Arraignment Part.

The judge released Becker on his own recognizance, as the charges did not qualify for bail under current state law. The Livingston County Public Defenderโ€™s Office represented Becker, while the District Attorneyโ€™s Office represented the prosecution.
