Livingston County, NY – A Livonia man is facing felony charges following a reported domestic incident that led to an arrest Thursday morning, according to the Livingston County Sheriff’s Office.

According to Sheriff Thomas J. Dougherty, deputies responded to a residence on Cleary Road in the Town of Livonia at approximately 6:40 a.m. on Thursday, January 8, after receiving a report of a domestic disturbance.

Investigators allege that 48-year-old Frank Malone of Livonia became involved in a physical altercation with a female at the residence. Authorities say the alleged incident occurred while an active order of protection was in place, prohibiting Malone from having contact with the female, elevating the case to a felony-level offense.

Following the investigation, Malone was arrested and charged with felony Criminal Contempt in the First Degree and Harassment in the Second Degree, according to the Sheriff’s Office. All charges are allegations, and Malone is presumed innocent unless proven guilty in court.

Malone was transported to the Livingston County Jail, where he was processed and held for pre-arraignment detention. He was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) before a Town of York Justice.

The Livingston County District Attorney’s Office recommended that Malone be held on $15,000 cash bail or credit. The judge ultimately remanded Malone to the custody of the Livingston County Sheriff in lieu of $5,000 cash bail or a $10,000 bond.

The Livingston County Public Defender’s Office was present and represented Malone during the arraignment, while the District Attorney’s Office appeared on behalf of the prosecution.

The case remains under review as it proceeds through the court system.
