ST. CHARLES, IL – Kane County prosecutors announced Friday that no charges will be filed against North Aurora police officers involved in the in-custody death of Jorge Valerio Martinez earlier this year.

According to the Kane County State’s Attorney’s Office, the decision follows an independent investigation by the Kane County Major Crimes Task Force. Officials reviewed body-worn camera footage, surveillance video, family interviews, and an autopsy report from the Kane County Coroner.

The incident began May 2, 2025, when a North Aurora officer and police intern stopped Martinez for a license plate violation. Officers reported signs of intoxication, and Martinez allegedly failed field sobriety tests before being arrested for DUI. Police say no force beyond handcuffing was used.

Upon arrival at the North Aurora Police Department, Martinez told officers he had a heart stent and needed medical attention. Officers immediately requested paramedics. Before they arrived, Martinez collapsed in the vehicle. Police removed his handcuffs and began life-saving measures until North Aurora Fire Department paramedics arrived and transported him to Mercy Hospital in Aurora. He was pronounced dead less than an hour later.

The coroner ruled that Martinez died from coronary artery disease, with cocaine intoxication as a significant contributing factor. Investigators also noted a history of heart problems and lack of recent medical treatment. His blood alcohol content was measured at 0.023.

State’s Attorney Jamie Mosser said officers acted lawfully, used minimal force, and provided prompt medical aid. “This was a tragic loss for Mr. Martinez’s family, and they remain in my thoughts,” Mosser stated.
