Geneva, IL – A Kane County judge has denied pretrial release for a Batavia man charged with first-degree murder after police say he called 911 and reported that he had just killed his wife early Tuesday morning.

According to Kane County State’s Attorney Jamie L. Mosser, 37-year-old Hector B. Luvianos was charged with first-degree murder, a Class M felony, following the December 23 incident.

Police said officers were dispatched around 4:37 a.m. Tuesday to an apartment in the 100 block of Church Street after Luvianos allegedly told dispatchers he had just committed the crime. Responding officers located Luvianos outside the building and took him into custody without incident.

Inside the apartment, officers discovered a female victim suffering from severe, life-threatening injuries. Despite efforts by first responders, she was pronounced dead at the scene, authorities said.

State’s Attorney Mosser confirmed that investigators believe this was a domestic-related incident involving two subjects and that there is no ongoing threat to the public. The Kane County Coroner’s Office is conducting an autopsy to determine the exact cause and manner of death.

Luvianos appeared in court on December 24, where the judge granted the state’s motion to deny pretrial release, keeping him detained in the Kane County Jail while his case proceeds.

Anyone with additional information is urged to contact the Batavia Police Department Investigations Division at (630) 454-2500.

The defendant is presumed innocent until proven guilty in a court of law.
