Wheaton, IL – A Batavia man will remain in custody after a DuPage County judge denied pre-trial release in connection with an alleged hit-and-run and high-speed chase that ended in a crash injuring two people.
According to the DuPage County State’s Attorney’s Office, 28-year-old Michael Fox appeared in court Tuesday facing multiple felony and misdemeanor charges, including aggravated fleeing and eluding, aggravated DUI, reckless driving and DUI. Authorities allege Fox’s blood alcohol content was .267 — more than three times the legal limit — at the time of the incident.
Police said the pursuit began around 5:11 p.m. Monday after Warrenville officers received reports of a hit-and-run at Route 59 and Joliet Street. An officer spotted the suspect vehicle and attempted a traffic stop near Williams and Butterfield roads. Authorities allege Fox initially stopped but then accelerated away, reaching speeds near 70 mph before running a red light at Route 59 and Butterfield and striking an occupied Honda CRV.
The two occupants of the Honda were taken to a hospital with minor injuries. Officers allegedly observed signs of intoxication in Fox, along with an open container of alcohol inside his vehicle.
“Illinois law requires that when you are involved in a traffic accident, you must remain at the scene until authorities arrive,” State’s Attorney Robert Berlin said in a statement, adding that Fox’s alleged conduct “placed others at significant risk.”
Warrenville Police Chief Sam Bonilla said the department takes DUI and reckless driving seriously, commending officers for “being vigilant and making every effort to protect the members of the public.”
Fox’s next court appearance is scheduled for Sept. 8 before Judge Daniel Guerin.
