The No-Refusal operation, conducted in partnership with area police agencies, will assist officers in obtaining search warrants for chemical testing from drivers who allegedly refuse DUI testing.
Assistant state’s attorneys will be on call to facilitate the warrant process so law enforcement can obtain legally mandated blood, breath, or urine tests, as required under Illinois law. Illinois courts have repeatedly ruled that individuals cannot refuse such testing when probable cause exists. Those who allegedly decline after a warrant is issued could face additional charges.
This marks the 40th No-Refusal initiative in Kane County since the program began in 2008.
“When a person decides to drink to excess and get behind the wheel of a car, they place everyone in danger,” said Kane County State’s Attorney Jamie L. Mosser in a statement. “Independence Day falls on a Friday this year, which means more people are likely to celebrate excessively and take unnecessary risks.”
Mosser urged residents to use alternatives like designated drivers, taxis, Uber, or Lyft. “Anyone who chooses to compromise public safety will be prosecuted to the fullest extent of the law,” she said.
