DuPage County Sheriff’s Deputy Injured in Alleged Pepper Spray Attack, Suspect in Custody

Wheaton, IL – A judge has denied pre-trial release for a Hanover Park man accused of pepper spraying a DuPage County sheriff’s deputy, causing serious injuries.

According to DuPage County officials, Leobejildo Torres, 58, faces multiple charges, including Aggravated Battery to a Police Officer – Great Bodily Harm, after allegedly assaulting deputies during an attempted theft investigation.

Deputies responded Wednesday to a construction site in unincorporated Roselle after reports of stolen materials. Investigators say Torres took items without permission, fled the scene, and was later found at a nearby gas station. When deputies attempted to detain him, Torres allegedly ran, then discharged pepper spray into a deputy’s face. The officer suffered severe knee injuries after collapsing.

Authorities allege Torres tried to spray two additional deputies before being apprehended. Police recovered two canisters of pepper spray from his possession.

DuPage County State’s Attorney Robert Berlin condemned the alleged attack, emphasizing law enforcement’s commitment to justice. Sheriff James Mendrick expressed support for the injured deputy and his recovery.

Torres remains in custody. His next court date is set for April 7.
