DuPage County, IL – Three suburban Chicago teens have been charged with sexually assaulting a female classmate during a high school graduation party in Roselle, according to the DuPage County State’s Attorney’s Office.

Authorities said the incident allegedly occurred between June 14 and June 15, 2025, during a Saint Viator High School graduation party. The victim reportedly contacted her sister and was later taken to a hospital by her family.

According to prosecutors, Kevin Niemiec, 18, of Prospect Heights; Zachary Mascolo, 18, of Arlington Heights; and Jon Clary II, 18, of Bartlett, each face multiple counts of criminal sexual assault. Judge Joshua Dieden ordered Niemiec held pre-trial, citing the seriousness of the allegations.

Officials said Mascolo and Clary were taken into custody in late December and remain detained at the DuPage County Jail. The defendants are barred from contacting the victim or her family and from consuming alcohol while awaiting trial.

State’s Attorney Robert Berlin called the accusations “extremely serious,” praising the Roselle Police Department and DuPage County Sheriff’s Office for their investigative work. Berlin also commended the victim for her “courage and strength” in coming forward.

Court appearances for the defendants are scheduled for January 12 and January 27, 2026, before Judge Ann Celine O’Hallaren Walsh.

Authorities emphasized that the charges are allegations and that the defendants are presumed innocent until proven guilty beyond a reasonable doubt.
