
Wheaton, IL – DuPage County State’s Attorney Robert Berlin announced Wednesday the dismissal of 19 cases—two felonies and 17 misdemeanors—due to inaccurate THC testing conducted by the UIC Analytical Forensic Testing Laboratory.
According to Berlin, the affected cases involved incorrect detection and quantification of THC, specifically the delta-8-THC and delta-9-THC isomers. A May 2024 report from UIC’s Laboratory Director, Albert Karl Larsen, revealed that the lab’s methodologies may not have effectively separated the two compounds, potentially leading to inaccurate test results.
The dismissed charges primarily included DUI counts, none of which resulted in sentences to the Illinois Department of Corrections. One felony case remains open due to an active arrest warrant for other related offenses. Additionally, one misdemeanor case involved testing conducted by the Illinois State Police Crime Lab during a protocol change for THC analysis.
