Claymont, DE – A Pennsylvania man was allegedly found in possession of a loaded firearm and multiple drugs after troopers responded to a report of an unresponsive bus passenger Sunday evening in Claymont.
According to Delaware State Police, the incident unfolded around 7 p.m. at the SEPTA station located at 191 Transit Center Drive. Authorities say troopers arrived to find 43-year-old Andrew Kucharczyk of Linwood, Pennsylvania, asleep and unresponsive in a passenger seat. While attempting to wake him, a trooper reportedly noticed a handgun partially exposed in Kucharczyk’s waistband. He was allegedly suspected to be under the influence of narcotics at the time.
Kucharczyk was taken into custody without incident, police allege. Officers say they recovered a loaded .380 Smith & Wesson handgun, which Kucharczyk did not have a permit to carry concealed. According to a police computer check, Kucharczyk is a convicted felon prohibited from possessing firearms or ammunition.
A subsequent search allegedly uncovered approximately .18 grams of suspected heroin, .5 grams of suspected crack cocaine, and various drug paraphernalia, according to police.
Kucharczyk was transported to Troop 1, arraigned in Justice of the Peace Court 11, and committed to the Howard R. Young Correctional Institution on a $56,600 cash bond. He faces multiple felony charges, including:
- Possession of a Firearm During the Commission of a Felony
- Possession of a Deadly Weapon by Person Prohibited Who Also Possesses a Controlled Substance
- Possession of a Firearm or Ammunition by Person Prohibited (2 counts)
- Carrying a Concealed Deadly Weapon
- Possession of a Firearm While Under the Influence
- Possession of a Controlled Substance (2 counts)
- Possession of Drug Paraphernalia
Police allege Kucharczyk remains in custody pending court proceedings.
