Batavia, IL – Kane County State’s Attorney Jamie L. Mosser on Tuesday concluded her review of an August 16, 2025, Batavia incident that ended with the death of a 39-year-old man, determining that no criminal charges will be filed against responding officers.

According to the Kane County State’s Attorney’s Office, the investigation found that Michael J. Seidelman died from a single self-inflicted gunshot wound to the head and was not struck by any rounds fired by law enforcement. The review also concluded that the deadly force used by a Batavia police officer and two Kane County Sheriff’s Office deputies was justified and within the law.

The incident occurred Saturday, August 16, 2025, around 3:45 p.m. in the 1200 block of East Wilson Street. Police were dispatched to a second-floor apartment after receiving a 911 call reporting a person harming himself and possibly experiencing a mental health crisis.

Authorities said officers heard two children screaming inside the apartment but were unable to force entry. Officers assisted the children in escaping through a balcony and moved them to safety. As Kane County sheriff’s deputies arrived, Seidelman allegedly began firing an AR-15 from inside the apartment toward officers. Law enforcement returned fire.

Investigators determined that although three officers discharged their weapons, none of their rounds struck Seidelman. Officials reported Seidelman fired more than 70 rounds both inside and outside the apartment. A final shot was heard around 4 p.m., and a SWAT team entered the apartment approximately 30 minutes later, where Seidelman was found deceased.

An independent investigation by the Kane County Major Crimes Task Force was conducted in the interest of transparency. While the Police and Community Relations Act mandates reviews of officer-involved deaths, officials noted this incident did not meet that definition under Illinois law.

Critical incident video has been released, and the case has been turned over to the Batavia Police Department for any further review.

State’s Attorney Mosser and Batavia Police Chief Eric Blowers both offered condolences to Seidelman’s family while commending officers for rescuing the children and protecting nearby residents.
