McDermott, Ohio – A McDermott man was arrested after shots were fired outside a residence early Sunday, prompting a Scioto County Sheriff’s Office investigation.

According to Scioto County Sheriff David Thoroughman, the 911 Communications Center received a call at approximately 6:04 a.m. Sunday from a concerned neighbor reporting a male standing in the roadway with a gun. Deputies responded to the 2400 block of Pollock Road in McDermott.

Sheriff Thoroughman stated that deputies learned a neighbor had already taken the firearm from the male and brought him inside a nearby residence in an attempt to keep him calm. The suspect allegedly claimed he had shot someone who was breaking into his home and that the individual was in a pond.

Detectives responded to the scene to process evidence and conduct a search. Investigators reported no indications that anyone else had been shot or was located on the property. Evidence showing where parts of the incident occurred was documented.

Authorities determined the male was allegedly under the influence of drugs at the time. Investigators also concluded the claim that someone was breaking into his home was unfounded. Detectives located a social media post made prior to the incident in which the suspect allegedly stated he was going to shoot up his stepfather’s house following a verbal altercation.

Kyle D. Mays, 22, of 2466 Pollock Road, McDermott, was arrested and charged with having weapons while under disability, a third-degree felony; discharging a firearm near a prohibited area (roadway), a second-degree felony; and two counts of improperly discharging a firearm at or into a habitation, second-degree felonies.

Mays is being held on a $70,000 bond and is scheduled to appear in Portsmouth Municipal Court on Monday, February 9.
