Westmont, IL – A Westmont man faces multiple criminal charges after allegedly showing pornographic material to three children at a public park Sunday, Oct. 25, prompting an investigation by local police and DuPage County prosecutors.
According to the DuPage County State's Attorney's Office, Westmont police responded to Diane Main Park around 4:25 p.m. following a report that a man had allegedly displayed pornography to minors.
Investigators allege that three children, ages 12, 13 and 14, were near a park pavilion when they heard noises coming from a bench where the defendant, identified as Rios, was seated using his phone.
Prosecutors allege that Rios invited the children to view material on his phone and subsequently displayed pornography while engaging in inappropriate behavior.
The children left the area and contacted police.
Responding officers located Rios and questioned him about the allegations.
Authorities allege that he initially provided a false name and repeatedly gave inconsistent personal information, including different ages and dates of birth.
Rios was subsequently taken into custody.
Prosecutors announced charges including two counts of sexual exploitation of a child, three counts of distributing harmful material to a minor and one count of obstructing identification.
Following his court appearance, Rios was released from custody under conditions prohibiting contact with anyone younger than 18 and entry into park facilities.
DuPage County State's Attorney Robert Berlin described the allegations as extremely disturbing and commended the children for reporting the incident.
Westmont Police Chief Brian Gruen also praised the children's quick response and the work of investigating officers.
Rios' next court appearance is scheduled for Monday, Nov. 23, 2026 , before Judge Joseph Bugos.
The allegations have not been proven in court. Rios is presumed innocent unless and until proven guilty beyond a reasonable doubt.
