The incident occurred on November 8, 2025, when a deputy with the Sheriff’s Office Road Patrol Division reportedly observed a motorcycle traveling at 76 mph in a 55-mph zone on Breesport North Chemung Road in the Town of Baldwin. Deputies say the operator accelerated after noticing the patrol car, continuing northbound at a high rate of speed before the motorcycle stalled on the roadway.
According to the Sheriff’s Office, the suspect then attempted to flee on foot but was apprehended after a short pursuit in which a deputy discharged a department-issued Taser. The operator was identified as Joseph M. Swinko, 35, of Elmira.
A search of Swinko’s property allegedly uncovered a bag containing over 30 grams of suspected methamphetamine, along with a scale and new baggies.
Swinko was arrested and charged with Criminal Possession of a Controlled Substance in the Third Degree with Intent to Sell (Class B felony), Resisting Arrest, Unlawful Fleeing a Police Officer in the Third Degree, and Obstructing Governmental Administration in the Second Degree, all misdemeanors.
He was issued appearance tickets and is scheduled to appear in Baldwin Town Court at a later date.
